These Terms of Use govern access to herbalradiantin.world and the purchase and use of personalized habit plans and related services offered by Herbalradiantin. By using our website or purchasing a plan, you agree to these terms. If you do not agree, please discontinue use.

1. Definitions

"We," "us," and "our" refer to Herbalradiantin. "You" and "client" refer to the individual or entity using our services. "Services" include habit assessments, written blueprints, coaching sessions, email support, and digital materials associated with Starter Rhythm Plan, Focus Stack Blueprint, and Full Life Cadence products. "Content" means text, graphics, worksheets, and tools provided through the Services.

2. Eligibility

You must be at least eighteen years old and capable of entering a binding contract under applicable law. Our Services provide lifestyle and habit coaching, not licensed medical, psychological, or legal advice. You are responsible for determining whether our Services are appropriate for your circumstances.

3. Orders and Payment

Prices displayed on plan-catalog.html are in euros and include applicable VAT for Netherlands clients unless stated otherwise. We reserve the right to correct pricing errors before acceptance. Payment is due at order confirmation unless alternate arrangements are agreed in writing. Failure to pay may result in suspension of Services.

4. Delivery of Services

After purchase, we will contact you to schedule intake and deliver your habit blueprint within the timeframe stated for your plan tier. Remote delivery is available throughout the Netherlands; in-person sessions are offered at our Amsterdam location when selected. Delays caused by incomplete information from you may extend timelines.

5. Client Responsibilities

You agree to provide accurate information, attend scheduled sessions or provide timely notice of cancellation, engage with materials in good faith, and communicate constraints that affect your plan. You are responsible for implementing habits at your own pace and for seeking professional support outside our scope when needed.

6. Intellectual Property

All Content, trademarks, and branding on herbalradiantin.world remain the property of Herbalradiantin or licensors. You receive a personal, non-transferable license to use materials for your own habit development. You may not reproduce, resell, or distribute Content commercially without written permission.

7. Confidentiality

We treat coaching discussions as confidential within our organization, subject to legal disclosure requirements and our Privacy Policy. You agree not to share proprietary frameworks or internal templates provided by us outside your household without consent.

8. Disclaimer of Warranties

Services are provided on an "as is" and "as available" basis. We do not guarantee specific outcomes from habit plans. Results depend on individual effort, context, and external factors. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

Nothing in these terms excludes liability that cannot be excluded under Dutch law. Subject to that, our total liability for any claim arising from Services shall not exceed the amount you paid for the relevant plan in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits, except where caused by our intentional misconduct or gross negligence.

10. Cancellation and Rescheduling

You may reschedule sessions with at least twenty-four hours notice. Repeated no-shows may incur fees or termination of remaining sessions without refund for missed portions. Cancellation rights for digital products and refunds are described in return.html.

11. Termination by Herbalradiantin

We may suspend or terminate Services if you breach these terms, harass staff, misuse Content, or engage in fraudulent payment activity. Where termination is for cause, refunds are at our discretion except as required by mandatory consumer law.

12. Force Majeure

We are not responsible for delays or failures due to events beyond reasonable control, including natural disasters, government actions, widespread network outages, or public health restrictions affecting in-person sessions. We will offer reasonable alternatives such as remote sessions where possible.

13. Governing Law and Disputes

These terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts in Amsterdam unless mandatory consumer rules grant jurisdiction elsewhere. Consumers in the EU may also use the European Online Dispute Resolution platform.

14. Changes to Terms

We may update these Terms of Use. The current version is always available at herbalradiantin.ddd. Material changes affecting active plans will be communicated with reasonable notice.
